This is a legal document, but our relationship is a partnership. In short, by using our services, you agree to pay for them as outlined in your plan. We agree to provide a powerful service and protect your data with the utmost integrity. You agree to use the service responsibly and not for illegal purposes. We both agree to be reasonable. 1. Agreement to Terms
Welcome to Hi-Level Digital. These Terms of Service ("Terms") govern your use of our AI-powered intake and automation system (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. This is a binding legal agreement.
2. The Service
Hi-Level Digital provides a "Case Growth Engine" for personal injury law firms. The specific features, including included usage minutes and integration capabilities, are determined by your selected subscription plan and are outlined on our Pricing page and in your specific Service Agreement.
3. Your Account and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You are also responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You agree to provide accurate and complete information when you register and to keep that information up to date.
4. Fees, Payment, and Subscription
Our Service is billed on a subscription basis, typically annually, as detailed in your Service Agreement. You agree to pay all applicable fees, including the one-time implementation fee and any recurring subscription fees. Payments are due in advance. All fees are non-refundable except as required by law or as explicitly stated in your Service Agreement.
5. Confidentiality and Client Data
We understand the critical importance of confidentiality in the legal industry. We will treat all information you provide about your firm and your potential clients ("Client Data") as confidential. We will not access your Client Data except as necessary to provide the Service, offer support, or as required by law. You retain all ownership rights to your Client Data. You are solely responsible for ensuring that your use of the Service complies with all applicable laws and ethical obligations regarding client confidentiality and data protection.
6. Intellectual Property
The Service, including its software, design, and content (excluding your Client Data), is the exclusive property of Hi-Level Digital and is protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of our Service without our express written permission.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Transmit any material that is abusive, harassing, or otherwise objectionable.
- Interfere with the security or performance of the Service.
- Attempt to gain unauthorized access to any part of our systems.
8. Term and Termination
Your agreement is effective for the term specified in your subscription plan. We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE'S RELIABILITY, AVAILABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, HI-LEVEL DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
10. Governing Law
These Terms shall be governed by the laws of the State of Tennessee, without regard to its conflict of law provisions.
11. Changes to Terms
We may modify these Terms from time to time. If we make a material change, we will provide you with reasonable notice prior to the change taking effect. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Terms.
